Terms of Service
These Terms of Service (“Terms”) govern access to and use of Caira websites, applications, and related services (collectively, the “Service”) provided by Armitive (“Caira,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a childcare center, you represent that you have authority to bind that organization.
The Service
Caira provides software to help licensed childcare centers manage daily operations, classroom documentation, parent communication, and related workflows. Features may include AI-assisted logging, insights, and planning tools. We may update or discontinue features with reasonable notice where practical.
Accounts and access
- Centers are responsible for managing staff and parent accounts and role assignments.
- You must keep login credentials confidential and notify us of unauthorized access.
- We may suspend or terminate access for violations of these Terms, abuse, or non-payment under a center agreement.
Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of childcare licensing requirements
- Upload content you do not have rights to share, including photos of children without required consents
- Attempt to bypass security, scrape the Service, or interfere with other users
- Misrepresent AI-generated content as human-reviewed when your center policy requires review
Centers remain responsible for compliance with applicable laws, including privacy, record-keeping, and parental notification requirements.
Content and data
You retain ownership of content you submit. You grant Caira a limited license to host, process, and display content solely to provide and improve the Service, including AI features enabled by your center.
Our Privacy Policy describes how we handle personal information.
AI features
AI outputs are suggestions. Centers and staff must review AI-generated summaries, insights, and communications before relying on them for compliance, safety, or parent-facing communications.
Third-party services
The Service may integrate with third-party platforms (e.g., cloud infrastructure, authentication). Their terms may apply to those components.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Caira is a tool to support center operations; it does not replace professional judgment, licensing inspections, or emergency procedures.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAIRA AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT PAID BY YOUR ORGANIZATION TO CAIRA FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100) IF NO FEES WERE PAID, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
Indemnification
You agree to indemnify and hold Caira harmless from claims arising from your content, your use of the Service, or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
Changes
We may modify these Terms. We will post updates on caira.care/terms with a revised “Last updated” date. Continued use after changes constitutes acceptance.
Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where mandatory local law applies.
